Terms of Service

1. Introduction

Welcome to MenuCraft. These Terms of Service ("Terms") govern your use of the MenuCraft web application and services (the "Service") operated by KIRYL RAHULENKA individuali veikla ("we", "us", or "our"), a sole proprietorship registered in Lithuania (Registration No. 1483873).

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Description of Service

MenuCraft is an AI-powered software-as-a-service (SaaS) platform that redesigns restaurant menus. You upload photos, a PDF, or a Word or text file with your menu; the Service recognizes its text, lets you check and correct it, and produces print-ready menu designs (PDF and PNG files) that keep the text you approved.

3. Account Registration

To use certain features of the Service, you must create an account using Google OAuth authentication via Supabase. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Pricing and Payments

Our Service operates on a credit-based system:

• Free Preview: Every user receives one (1) free design preview with a watermark. Downloads are not included.
• Credit Packs: Credits are sold in packs: 100 credits for $10 USD and 300 credits for $25 USD. Your first pack also unlocks downloads of PDF and PNG files.
• Using Credits: A new design costs 10 credits and a change to an existing design costs 3 credits. Correcting menu text and updating it in a saved design is free. Credits do not expire.

All payments are processed securely through Stripe. Prices are subject to change with reasonable notice to existing users.

5. User Content

You retain ownership of all content you upload to the Service, including menu photos, PDF files and menu text. By uploading content, you grant us a limited license to process and store this content solely for the purpose of providing the Service to you.

You represent and warrant that you have all necessary rights to the content you upload and that such content does not infringe on any third-party rights.

6. Generated Content

The menu designs generated by our AI Service are provided for your use. You receive full rights to use, modify, and distribute the generated designs for your business purposes. However, we do not guarantee that generated designs are free from similarity to other existing designs.

7. Prohibited Uses

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes on intellectual property rights
• Attempt to reverse engineer or extract the AI models or algorithms
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization
• Upload malicious content or attempt to compromise the Service

8. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We reserve the right to modify or discontinue the Service with reasonable notice.

9. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claims arising from your use of the Service shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

10. Intellectual Property

The Service, including its design, features, and underlying technology, is protected by intellectual property laws. All rights not expressly granted to you are reserved by us.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on our website. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Vilnius, Lithuania.

For consumers in the European Union, this choice of law does not deprive you of the protection afforded by provisions that cannot be derogated from by agreement under the laws of your country of residence.
